The following is a legal agreement between you (“purchaser”) and the owner of www.jmphotographics.com ("Website"), jm photographics, LLC ("jm photographics,” “Jason R. Meek”), which governs your use of all action sets purchased from this Website (including information, text, images, graphics, data or other materials, products, and services provided through www.jmphotographics.com (“products”).
By making this purchase, you agree to be bound by the terms of this Agreement automatically, without any other conditions or declarations. If you do not agree with these terms, you are not allowed to make this purchase.
By accessing this website, you agree to be bound by this website's Terms and Conditions of Use and all applicable laws and regulations. You agree that you are responsible for compliance with any applicable local laws. If you do not agree with these terms, you are prohibited from using or accessing this site and should close your web browser. The materials on this website are protected by the United States and international copyright and trademark laws. You agree to honor such copyright and trademarks when accessing this site. Individual Products and Services listed on this site have their Terms and Conditions listed on their product’s web pages, and you agree to read, understand and abide by their terms and conditions, which may and likely are different than the terms and conditions of this website, including warranties, return policies and exchange policies.
COPYRIGHT - All images, photographs, products, and layouts of any templates created or taken by jm photographics are his property, will remain his property, and are protected by United States Copyright Laws (USC Title 17). Clients with this waive any claims for ownership, income, editorial control, and use of any images being registered and protected under US copyright law. They are not to be redistributed or resold in any form. Those who violate this licensing agreement and Federal Law will be prosecuted to the fullest extent of its Civil and Criminal Penalties.
LICENSE - You acknowledge that the ownership of an image or product does not get transferred to you by your purchase, and you must not claim that it is yours. Your license is non-transferable, meaning you are not allowed to sell, distribute, rent, copy, sketch, photograph, give, sub-license, or otherwise transfer the images or products or the right to use the images or products set to anyone else.
INSTALLATION AND USAGE - The images or products may be installed on all computers directly owned by the purchaser of the product. By purchasing these products, you agree to NOT resell or redistribute these products to others (i.e., friends, photographers, relatives, etc.) or install the products on computers not owned by the purchaser, unless otherwise acquired a signed Copyright Release by jm photographics.
You may not modify or superficially alter images, storyboards, templates, or products and then resell them as your own. You may not dissect the effects and then use my ideas in your products for resale. For example, you may not purchase a product, modify it by adding your paper and resell the modified storyboard.
You may not place any of my products, modified or unmodified, on a diskette, DVD, CD, Flash Drive, website, forums, or any other medium and offer them for redistribution or resale in a fashion that would violate this license.
RETURN POLICY - You acknowledge that all images and products on the jm photographics Website are non-refundable and not returnable under any circumstances. Before purchasing, please select the proper Collection, package, paper, color, quantity, or product. Please do not purchase if you are not willing to take the risk.
REPLACEMENT POLICY - Jason R. Meek - jm photographics expects clients to back up their images onto an external hard drive, storage space, or disc for replacement purposes. It is your responsibility to back up your purchases. If you cannot locate your products after a computer failure or when moving computers, I will try and assist you but are in no way obligated to store or re-issue your purchases. It is time-consuming for me to look through thousands of transactions to locate your assets. If you cannot provide a receipt, we will discount previously purchased actions at 50% off current website prices assuming I can verify your purchase. To start this process, you will need to provide me with the month and year each was purchased and the email address used for payment. Incomplete or inaccurate information may make this option unavailable.
DISCLAIMER OF WARRANTIES AND LIABILITIES - Upon receipt of a photo Disc, you accept all responsibility for archiving and protecting the photographs. Not all pictures are permanently archived image files. It is not my responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided. You are responsible for ensuring that digital files are copied to new media as required.
THE WEBSITE AND THE ACTIONS AND PRESETS ARE PROVIDED "AS IS." I OFFER NO WARRANTY, EXPLICIT OR IMPLIED, REGARDING ANY ACTIONS, PRESETS, THE WEBSITE, THE ACCURACY OF ANY INFORMATION, OR ANY RIGHTS OR LICENSES UNDER THIS AGREEMENT, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. MCP ACTIONS DO NOT REPRESENT OR WARRANT THAT THE WEBSITE OR THE ACTIONS OR PRESETS WILL MEET YOUR REQUIREMENTS OR THEIR USE WILL BE UNINTERRUPTED OR ERROR-FREE.
MCP ACTIONS SHALL NOT BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, PUNITIVE, SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, LOST PROFITS, OR ANY OTHER DAMAGES, COSTS, OR LOSSES ARISING OUT OF YOUR USE OF THE WEBSITE OR THE ACTIONS.
